MADURAI: Taking a serious view in a case where the authorities had given completion certificate to an apartment building in Trichy district without taking note of the unauthorised construction, the Madras high court has directed the state government to initiate departmental proceedings against the concerned officials.

The court was hearing the petition filed by G Shanmugasundar, a resident of Chennai.

The petitioner sought for a direction to the authorities to take action to demolish the unauthorized construction of an apartment building at Uyyakondan Thirumalai village at Srirangam taluk in Trichy district and to restore the building to its original approved plan.

The petitioner also sought to initiate necessary disciplinary action against the concerned officials who failed to take any action against the unauthorised construction. A division bench of justice R Mahadevan and justice J Sathya Narayana Prasad observed that a division bench of the court by referring to Supreme Court judgments had passed a series of directions with regard to the issue of demolition of unauthorised constructions.

Despite the orders of the Supreme Court and this court, the authorities have not followed the same while granting planning permission and issuing completion certificate to the apartment building.

Hence, the judges directed the state government to initiate departmental proceedings against the officials. The judges further directed to file an action taken report before the court within two weeks.
