The division bench of justice Mukta Gupta and justice Anish Dayal dismissed the appeals filed by the three men who were convicted on December 15, 2018, and awarded life sentences.
“Considering the manner in which the offences were committed by the appellants, this Court finds no error in the impugned order on sentence, directing the appellants to undergo life imprisonment. As noted above, it will be for the appellants to seek remission from the State Government in terms of Section 432 Cr.P.C,” the bench said.
In 2011, the minor, who lived in Faridabad, was taken to a house in Delhi by his relative and raped. When she managed to escape, some men in a car offered her help and assured her to safely drop at her house. Later, they took the girl to an isolated place in Dwarka and gang-raped her.
One of the convicts (relative of the girl) was convicted under IPC sections 366, 376 and 34 (Acts done by several persons in furtherance of common intention), the other two were convicted under sections 366, 376(2)(g) (gang rape) and 34.
“In view of the cogent and convincing testimony of the prosecutrix, duly corroborated by the facts that Bijender was apprehended when she called for help from the people sitting in cars going at that time. Soon thereafter, her medical was conducted, and she got her statement recorded wherein she implicated the Appellant, Bijender and two other accused whom she could identify on being produced and the DNA report, this Court finds no error in the judgment convicting the appellants,” said the bench.
