Arbitration and Conciliation Act (26 of 1996) , S.11(6), S.11(12)— Appointment of arbitrator – By Court – Arbitration clause in all agreements executed between parties acknowledged by Operator – When efforts to amicably resolve disputes through Mediation failed, operator proposed to consolidate disputes under all agreements and refer them to sole arbitrator in single arbitration – Operator cannot now oppose petitions seeking appointment of arbitrator on ground that matter regarding determination of requisite stamp duty was pending before Collector – No legal impediment to enforceability of arbitration agreement pending payment of stamp duty on substantive contract – Former Judge of Bombay High Court appointed as sole arbitrator.
